TERMS OF SERVICE
OVERVIEW
Welcome to Belle House Pantry.
These Terms of Service (“Terms”) govern your access to and use of the Belle House Pantry website, online store, products, content,
recipes, features, tools and related services (collectively, the “Services”).
Throughout these Terms, “Belle House Pantry,” “we,” “us” and “our” refer to Belle House Pantry and the legal entity that operates it.
Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.
Please read these Terms carefully. By visiting, accessing, purchasing from, or otherwise using our Services, you agree to be bound by
these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, please do not use the Services.
1. ELIGIBILITY AND ACCOUNTS
By using the Services, you represent that you are at least the age of majority in your state or jurisdiction of residence, or that you are
the age of majority and have consented to the use of the Services by any minor dependents under your supervision.
You may be asked to provide information including your name, email address, billing information, payment information and shipping
address. You agree that the information you provide is accurate, current and complete and that you have the right to provide it.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for
activity occurring through your account.
You may not sell, transfer, assign or license your account to another person.
2. OUR PRODUCTS
We make every reasonable effort to accurately describe and photograph the products offered through Belle House Pantry.
Because computer and mobile displays vary, we cannot guarantee that colors, packaging or other visual details displayed on your
screen will appear the same as the physical product you receive.
Packaging, product appearance and presentation may occasionally change without notice. We may also modify or discontinue
products, flavors, sizes, collections or other offerings at any time.
We reserve the right to limit the sale or quantity of products available to any person, household, geographic region or jurisdiction
where reasonably necessary.
3. FOOD PRODUCTS, INGREDIENTS AND ALLERGENS
Belle House Pantry sells food products, including baking mixes, dessert mixes, pantry products, olive oils and other edible goods.
Please carefully review the ingredient statement, allergen declaration, preparation instructions, storage instructions and other
information provided with each product before use.
Our products may contain or may be produced or packaged in facilities that also handle, common food allergens. Please refer to the
packaging of the specific product you receive for the most current ingredient and allergen information.
If you or someone for whom you are preparing food has a food allergy, sensitivity, intolerance or other dietary restriction, it is your
responsibility to determine whether a product and any additional ingredients called for in its preparation are appropriate for that
person.
Product formulations and suppliers may change from time to time. For that reason, information appearing on the physical product
packaging should be reviewed before preparation or consumption.
Nothing on our website is intended as medical, nutritional or dietary advice.
4. RECIPES, PREPARATION INSTRUCTIONS AND BAKING RESULTS
Belle House Pantry may provide recipes, preparation instructions, serving suggestions, Baker’s Tips, adaptations and other culinary
information through our website, product packaging, recipe cards, social media or other materials.
We take care in developing and testing our recipes and instructions. However, individual results may vary due to factors outside our
control, including ovens, appliances, cookware, altitude, humidity, measuring technique, ingredient substitutions, ingredient temperatures
and variations in ingredients supplied by the customer.
For best results, follow the instructions accompanying the product and use the ingredients, quantities, pan sizes, temperatures and
preparation methods specified.
Recipes and culinary information are provided for general informational purposes and personal use.
5. ORDERS
When you submit an order, you are making an offer to purchase the products in your cart.
We reserve the right to accept, decline or cancel an order, including in cases involving suspected fraud, unauthorized transactions,
product availability, pricing or listing errors, shipping limitations or unusually large quantities.
An automated order confirmation does not necessarily constitute final acceptance of an order. Payment must be authorized and
processed before an order can be fulfilled.
Please review your order carefully before submitting it. Once an order has entered processing or fulfillment, we may be unable to
change or cancel it.
If we cancel an order after payment has been processed, we will refund the applicable amount to the original payment method.
Purchases are intended for personal or household use unless otherwise agreed by us in writing. Products may not be purchased for
unauthorized commercial resale.
6. PRICES, PAYMENT AND PROMOTIONS
All prices are listed in U.S. dollars unless otherwise indicated.
Prices, products, discounts and promotions may change without notice. The price charged will generally be the price displayed at the
time you submit your order, subject to correction of errors as permitted by law.
Unless otherwise stated, product prices do not include applicable taxes, shipping charges, handling charges, customs duties or other
fees.
Prices offered through Belle House Pantry's online store may differ from prices offered at Belle Epicurean cafés, retail locations, events,
wholesale accounts or other sales channels.
Promotional offers may be subject to additional terms. If the terms of a specific promotion conflict with these Terms, the terms of the
promotion will control with respect to that promotion.
You represent that you are authorized to use the payment method submitted with your order and agree to pay all authorized charges
associated with your purchase.
7. SHIPPING AND DELIVERY
Orders are shipped according to our Shipping Policy and the shipping method selected or offered at checkout.
Processing and delivery dates are estimates unless we expressly state otherwise. Carrier delays, severe weather, natural disasters,
high-volume periods, customs processing, incorrect addresses and other circumstances outside our reasonable control may affect
delivery.
Please provide a complete and accurate shipping address. Customers are responsible for reviewing shipping information before
submitting an order.
If an order arrives damaged, contains an incorrect item, or is missing an item, please contact us promptly at
contact@bellehousepantry.com so that we can assist you.

8. RETURNS AND REFUNDS
Because many Belle House Pantry products are food items, most edible products cannot be returned or exchanged once shipped.
Our complete rules regarding damaged products, incorrect or missing items, eligible non-food merchandise, refunds and final-sale items
are set forth in our Return & Refund Policy, which is incorporated into these Terms by reference.
If there is a conflict between this section and our Return & Refund Policy concerning a return or refund, the Return & Refund Policy will
control.
Nothing in our Return & Refund Policy or these Terms limits rights that cannot legally be waived under applicable law.
9. INTELLECTUAL PROPERTY
The Belle House Pantry Services and their contents—including our names, trademarks, logos, product names, packaging designs,
photographs, graphics, text, recipes, recipe cards, written materials, videos, audio, illustrations, website design and other original
content—are owned by or licensed to Belle House Pantry and are protected by applicable intellectual property laws.
The Services are provided for your personal, non-commercial use.
Unless we give you prior written permission, you may not reproduce, republish, sell, distribute, modify, commercially exploit or create
derivative works from our proprietary content.
You may, of course, print or save recipes and preparation materials we specifically provide for personal home use.
“Belle House Pantry,” our logos, product names, designs and slogans are trademarks or other proprietary identifiers of Belle House
Pantry or its affiliates and may not be used in a manner that suggests affiliation, sponsorship or endorsement without our permission.
Third-party names and trademarks appearing through the Services belong to their respective owners.
10. THIRD-PARTY SERVICES AND TOOLS
We may provide access to tools, applications, payment services, social media services or other functionality operated by third parties.
We do not necessarily control these third-party services. Your use of them may be subject to separate terms and privacy practices
established by the applicable third party.
To the extent permitted by law, Belle House Pantry is not responsible for third-party services that we do not operate or control.
11. THIRD-PARTY LINKS
Our Services may contain links to websites or resources operated by third parties.
These links are provided for convenience and do not necessarily constitute our endorsement of the third party or its products, services or
content.
We are not responsible for the content, availability, security or practices of third-party websites. If you choose to visit or transact with a
third-party website, you should review that party's terms, policies and practices.
12. SHOPIFY
Belle House Pantry's online store is powered by Shopify.
Purchases from our store, however, are transactions between you and Belle House Pantry. Shopify provides technology and services
that support our online store but is not the seller of Belle House Pantry products.
Your information may also be processed by Shopify in connection with the operation of our store, as described in our Privacy Policy
and Shopify's applicable privacy disclosures.
13. PRIVACY
Your privacy matters to us.
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our online store is hosted by Shopify and may use additional service providers for functions such as payment processing,
shipping, analytics and marketing, certain personal information may be processed by those service providers as necessary to provide
the Services.

14. REVIEWS, PHOTOS AND OTHER USER CONTENT
You may have opportunities to submit reviews, photographs, comments, suggestions, recipes, ideas or other content (“User Content”).
You retain ownership of content you create. By voluntarily submitting User Content to us or through areas of the Services intended for
public or promotional submissions, you grant Belle House Pantry a non-exclusive, worldwide, royalty-free license to use, reproduce,
display, distribute and adapt that User Content in connection with operating, improving and promoting Belle House Pantry and its
Services, subject to applicable law.
You represent that you own or have permission to submit the User Content and that our permitted use of it will not violate another
person's intellectual property, privacy, publicity or other rights.
You may not submit content that is unlawful, defamatory, threatening, obscene, fraudulent, malicious or that infringes another person's
rights.
We reserve the right, but are not obligated, to moderate or remove User Content where appropriate.
15. ERRORS, INACCURACIES AND AVAILABILITY
Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions,
ingredients, availability, pricing, promotions, shipping charges or delivery estimates.
We reserve the right to correct errors or update information and, where permitted by law, to cancel an affected order.
If an order is canceled because of an error after payment has been collected, the applicable amount will be refunded.
16. PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services to:
* violate applicable laws or regulations;
* infringe our intellectual property rights or those of another person;
* engage in fraudulent, deceptive, abusive, threatening or unlawful activity;
* transmit viruses, malicious code or harmful software;
* obtain or attempt to obtain unauthorized access to our systems or another user's information;
* interfere with the security or operation of the Services;
* collect personal information about others without authorization;
* impersonate another person or entity;
* send spam or unauthorized commercial communications; or
* reproduce, scrape, extract, copy or commercially exploit substantial portions of the Services without our authorization.
We may restrict or terminate access to the Services if we reasonably believe these Terms have been violated.
17. AUTOMATED SYSTEMS AND AGENTS
Automated systems, bots, artificial-intelligence agents and similar technologies may not access or interact with the Services in a manner
that circumvents security measures, access controls, robot exclusion protocols, rate limits or other technical restrictions established by us
or our service providers.
Automated systems must not misrepresent themselves as human users or circumvent measures intended to distinguish automated activity
from human activity.
We reserve the right to restrict automated access to the Services where reasonably necessary to protect our customers, systems,
intellectual property or business operations.
18. TERMINATION
We may suspend or terminate access to all or part of the Services if you materially violate these Terms, misuse the Services, engage in
fraudulent or unlawful activity, or where suspension or termination is otherwise reasonably necessary to protect Belle House Pantry, our
customers or our service providers.
Termination does not eliminate payment obligations or other obligations incurred before termination.
Provisions that by their nature should survive termination—including provisions concerning intellectual property, user content, liability,
indemnification and governing law—will remain effective.
19. WARRANTIES AND DISCLAIMERS
We strive to provide high-quality products and accurate information.
Except for warranties expressly provided by us and warranties or rights that cannot lawfully be excluded, the Services and
informational content are provided on an “as available” basis.
We do not warrant that access to our website will always be uninterrupted, secure or error-free, or that every piece of informational
content will be free from inadvertent error.
Nothing in these Terms is intended to disclaim, exclude or limit any warranty, consumer protection, remedy or other right that cannot be
disclaimed, excluded or limited under applicable law.
20. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BELLE HOUSE PANTRY AND ITS AFFILIATES, OWNERS, DIRECTORS,
OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT,
INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE
SERVICES.
THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, LOSS OF PROFITS, REVENUE, DATA OR BUSINESS OPPORTUNITIES.
THE LIMITATIONS IN THIS SECTION DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
Nothing in these Terms is intended to limit any rights or remedies available to consumers under applicable law.
21. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Belle House Pantry and its affiliates, owners,
directors, officers, employees, agents and service providers from third-party claims, losses, liabilities and reasonable expenses arising
from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person's rights.
This provision does not require you to indemnify Belle House Pantry for liability caused by Belle House Pantry's own conduct where such
indemnification would be prohibited by law.
22. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the fullest
extent permitted by law or, where necessary, severed from these Terms.
The remaining provisions will continue in full force and effect.
23. WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.
These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy and any other policies expressly incorporated by
reference, constitute the agreement governing your use of the Services.
24. ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, change of
control or other lawful business transaction.
25. GOVERNING LAW
These Terms and your use of the Services are governed by the laws of the State of Washington, without regard to conflict-of-law
principles, except where applicable law requires otherwise.
To the extent permitted by applicable law, disputes arising from these Terms or the Services will be brought in the state or federal
courts having jurisdiction in King County, Washington.
Nothing in this section deprives a consumer of protections or rights that cannot lawfully be waived.
26. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices or applicable law.
The current version will be posted on this page with an updated “Last Updated” date.
Where required by law, we will provide additional notice of material changes.
Your continued use of the Services after revised Terms become effective constitutes acceptance of those revised Terms to the extent
permitted by applicable law.
